ORDINANCE NO. BL2006-1132

An ordinance abandoning a 10" sanitary sewer line and easement that will be replaced by a 10" and a 12" sanitary sewer line, that is shown on Map 092-12, Parcels 447, 450-452, 455, and 457-462, Project 06-SL-03, West End Summit, authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-034U-10).

WHEREAS, a 10" existing sanitary sewer line and accompanying easement, more particularly described in Project No. 06-SL-03, West End Summit, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a 10" and a 12" sanitary sewer line will be replacing the existing 10" sanitary sewer line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-034U-10 on March 15, 2006 for abandonment of said easement and sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 10" sanitary sewer line and the easement shown on Map 092-12, Parcels 447, 450-452, 455, and 457-462, Project No. 06-SL-03, West End Summit as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
