An ordinance abandoning a 15' public utility drainage easement, that is shown on Map 106-11, Parcel 005.00, Project 06-SC-20, 305 Hill Avenue, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-030U-11).

WHEREAS, a 15' Public Utility Drainage Easement, more particularly described in Project No. 06-SC-20, 305 Hill Avenue, on record in the department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2006M-030U-11 on February 28, 2006 for abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 15' Public Utility Drainage Easement shown on Map 106-11, Parcel 005.00, Project No. 06-SC-20, 305 Hill Avenue as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
