An Ordinance amending Section 17.40.120 of Title 17 of the Metropolitan Code, Zoning Regulations, to require Council approval of modifications to planned unit developments that increase the number of residential dwelling units, all of which is more specifically described herein (Proposal No. 2006Z-080T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.40.120 as follows:

1. By amending Section 17.40.120.F.1 by relettering subsection d as subsection e, and by adding the following new subsection d:

"d. An increase in the total number of residential dwelling units; or"

2. By deleting Section 17.40.120.G.2.f in its entirety and by adding the following new Section 17.40.120.G.2.f:

"f. There is no increase in the total number of residential dwelling units, even if the number of residential dwelling units was decreased by a prior modification;"

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2006-1051 by deleting Section 1 in its entirety and substituting in lieu thereof the following:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.40.120 as follows:

1. By amending Section 17.40.120.F.1 by re-lettering subsection d as subsection e, and by adding the following new subsection d:

"d. An increase in the total number of residential dwelling units above the number last authorized by council ordinance or, for a PUD district enacted by council ordinance after August 1, 2006, an increase in the total number of residential dwelling units above the number last authorized by council ordinance or above the number last authorized by the most recent modification or revision by the planning commission; or"

I move to amend Ordinance No. BL2006-1051, as amended, by amending Section 1 by deleting the phrase "August 1, 2006", and substituting in lieu thereof the phrase "September 1, 2006".
