ORDINANCE NO. BL2006-1141

An ordinance abandoning an 8" and a 30" sewer line and easement and a 6" water line and easement that will be replaced by an 8" and 30" sewer and an 8" water line and easement that is shown on Map 92-8, Parcels 160-162, Project 05-SL-141 and 05-WL-156, John Henry Hale Homes, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2005M-200U-08).

WHEREAS, a 6" existing water line and accompanying easement, and an 8" and 30" sanitary sewer line and easement more particularly described in Project No. 05-SL-141 and 05-WL-156, John Henry Hale Homes, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, an 8" water line and easement and an 8" and 30" sanitary sewer line and easement will be replacing the existing 6" water line and easement and 8" and 30" sanitary sewer line; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-200U-08 on March 28, 2006 for abandonment of said easement and water and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 6"water line and the easement and the 8" and 30" sanitary sewer and easement shown on Map 92-8, Parcels 160-162, Project No. 05-SL-141 and 05-WL-156, John Henry Hale Homes as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
