ORDINANCE NO. BL2006-1140

An ordinance authorizing the Director of the Division of Public Property and the Director of Parks and Recreation, or his designee, to accept, execute and record an agreement accepting a grant of easement from the State of Tennessee for use in the Seven Mile Creek greenway system (Proposal No. 2006M-088U-12).

Whereas, the State of Tennessee is the owner of a certain 40-acre parcel of property (the "Property") adjacent to Ellington Agricultural Center, located on the west side of Edmonson Pike south of Briarwood Drive and having the map and parcel number 14700000100, as shown on the map attached as Exhibit 1 to this ordinance.

Whereas, the State of Tennessee is considering granting an easement to the Metropolitan Government to allow a portion of the Property to be used for the construction, operation and maintenance of part of the Seven Mile Creek greenway; and

Whereas, the precise boundaries of the easement are to be located by survey; and

Whereas, if approved by the State of Tennessee, the terms of the grant of easement will in material respects be as shown in the document attached as Exhibit 2 to this ordinance.

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of the Division of Public Property and the Director of Parks and Recreation, or his designee, are authorized to accept, execute and record an agreement for dedication of easement having terms not materially different from those shown in Exhibit 2.

Section 2. The easement contemplated in this ordinance shall have boundaries determined by survey acceptable to the Director of the Division of Public Property and the Director of Parks and Recreation.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
