Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.
The invocation was offered by Reverend Clifton Lewis, Sr. of Hopewell Baptist Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -
PROPOSED AMENDMENT TO COUNCIL RULE 23
Ms. Williams, Chair of the Rules-Confirmations-Public Elections Committee, reported that the Committee had considered and made no recommendation of the following proposed amendment to Rule No. 23 of the Rules of Procedure of the Metropolitan Council:
Any resolution or proposed
ordinance on introduction and first reading shall be deferred one meeting
if such resolution or proposed ordinance is not introduced or co-sponsored by
the Council member
from district concerned with the subject matter of such legislation. This provision
shall not apply
to zoning measures introduced under Rule 9 or if the Council member from the
district concerned
declines to introduce o co-sponsor such legislation.

PROPOSED AMENDMENT TO COUNCIL RULE 12
Ms. Williams, Chair of the Rules-Confirmations-Public Elections Committee, reported that the Committee had considered and recommended approval of the following proposed amendment to Rule No. 12 of the Rules of Procedure of the Metropolitan Council:
The Metropolitan Clerk shall
restrict the number of memorializing resolutions, resolutions requesting
information, or similar resolutions which are not binding legislation sponsored
by the same member
of Council on the agenda of any meeting to a total not to exceed three. Those
resolutions placed on
the agenda shall be determined by their filing order with the Metropolitan Clerk.
Mr. Briley moved to defer action on the proposed amendment, which motion was seconded and adopted by a voice vote of the Council.

Reappointment of Mr. Robert E. McNeilly, Jr. to the Metropolitan Action Commission
for a term expiring February 2, 2005. The Rules-Confirmations-Public Elections
Committee recommended the appointment, and Ms. Williams moved for confirmation,
which motion was seconded and adopted by a unanimous vote of the Council.
Civil
Service Commission
Reappointment of Mr. Greg Rodriguez to the Civil Service Commission for a term
expiring March 31, 2007. The Rules-Confirmations-Public Elections Committee
recommended the appointment, and Ms. Williams moved for confirmation, which
motion was seconded and adopted by a unanimous vote of the Council.
Educational
Access Corporation
Appointment of Dr. David Jones, Jr. to the Educational Access Corporation for
a term expiring February 5, 2003. In the absence of the appointee, the appointment
was deferred.
Board
of Fair Commissioners
Reappointment of Mr. Alex Joyce to the Board of Fair Commissioners for a term
expiring April 6, 2007. The Rules-Confirmations-Public Elections Committee recommended
the appointment, and Ms. Williams moved for confirmation, which motion was seconded
and adopted by a unanimous vote of the Council.
Hospital
Authority
Appointment of Mr. Waverly Crenshaw for a term expiring November 1, 2003. In
the absence of the appointee, the appointment was deferred.
Board
of Parks and Recreation
Reappointment of Ms. Jenny Hannon to the Board of Parks and Recreation for a
term expiring April 30, 2007. In the absence of the appointee, the appointment
was deferred.

of Property Standards and Appeals
Reappointment of Ms. Jan Bushing to the Board of Property Standard and Appeals
for a term expiring April 7, 2006. The Rules-Confirmations-Public Elections
Committee recommended the appointment, and Ms. Williams moved for confirmation,
which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Dr. Dante Roa to the Public, Educational and Governmental Access
Committee for a term expiring November 4, 2004. The Rules-Confirmations-Public
Elections Committee recommended the appointment, and Ms. Williams moved for
confirmation, which motion was seconded and adopted by a unanimous vote of the
Council.
Sports
Authority
Appointment of Mr. Denny Bottorff to the Sports Authority Board for a term expiring
December 19, 2005. In the absence of the appointee, the appointment was deferred.
Appointment of Mr. Ed Temple to the Sports Authority Board for a term expiring December 19, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
- RESOLUTIONS -
A resolution requesting the Solid Waste Division of the Department of Public Works to construct the additional convenience centers and to determine the feasibility of providing a free day each week for disposal at the convenience centers. The Public Works Committee recommended deferment of the resolution. Mr. Black moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support legislation that abolishes passage of the National Teacher Examination as a requirement for teacher licensing. The Education Committee recommended deferment of the resolution. Mr. Stanley moved to defer action on the resolution and re-refer to the Education Committee, which motion was seconded and adopted by a voice vote of the Council.
RESOLUTION
NO. RS2002-934
A resolution requesting the Davidson County Delegation to the Tennessee General
Assembly to support the adoption of legislation SB1235/HB0295 that would enable
local governments to impose real estate transfer taxes. The Rules-Confirmations-Public
Elections Committee recommended deferment of the resolution. Mr. Bogen moved
to defer the resolution, which motion was seconded and adopted by a voice vote
of the Council.
A resolution requesting the Metropolitan Traffic and Parking Commission to reconsider its decision to deny 30 minutes of free parking in all Metro-owned lots and garages if persons park only 30 minutes or less. The resolution was approved by the Traffic and Parking Committee. A resolution requesting the Metropolitan Department of Public Works to initiate a policy to reinstall residents' mailboxes knocked down as a result of traffic accidents, vandalism, or other unforeseen circumstances, which were originally installed into the sidewalk by the Department of Public Works. The resolution was deferred by the Public Works Committee. Mr. Dillard moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution authorizing the Director of Public Property to exercise an option to purchase real property (Map 98, Parcels 101 and 163 - John Hager Road) on which to construct the new Ruby Major Elementary School and a future middle school. (Proposal No. 2002M-003G-14). The resolution was approved by the Planning Commission, Budget and Finance, Education and Planning, Zoning and Historical Committees. A resolution requesting that public and privately-owned arenas and stadiums in the area of the Metropolitan Government decline to be the site for a proposed Mike Tyson heavyweight boxing event. The Rules-Confirmations-Public Elections Committee recommended indefinite deferment of the resolution. Mr. Summers moved to defer action indefinitely on the resolution, which motion was seconded and adopted by a voice vote of the Council.
RESOLUTION NO. RS2002-948
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to ask Governor Don Sundquist to issue a moratorium on capital punishment and to commute the death sentence of Abu-Ali AbdurRahman. Ms. Gilmore offered a substitute resolution and moved that it be accepted for filing and no objection was made.

A substitute resolution requesting the Davidson County Delegation to the Tennessee General Assembly to ask Governor Don Sundquist to issue a moratorium on capital punishment. A resolution ratifying an agreement with the Treasury Department of the State of Tennessee in order to deposit local funds for Local Program No. 3349, Bridge over CSX Railroad (LM 1.57), on Chestnut Street. A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5844 with the State of Tennessee, Department of Transportation, for Distribution and Collection System Relocations, said construction being necessary as part of State Project No. STP-M-5333(1), 19958-2732-54, (Metro Project Nos. 99-SG-182A & 99-WG-177A) and ratifying an agreement with the Treasury Department of the State of Tennessee. A resolution authorizing the Department of Law to compromise and settle the lawsuit of Jason Parks against Charles Rutzky in the amount of $15,000, of which the Metropolitan Government shall contribute $12,500. - BILLS ON INTRODUCTION AND FIRST READING -
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to R10 District property at 4220 Lavergne Couchville Pike, approximately 250 feet south of Pin Hook Road, (3.95 acres), all of which is more particularly described herein (Proposal No. 2001Z-124G-13). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to CS District property at 4119 Murfreesboro Pike, approximately 1,100 feet northwest of Hurricane Creek Boulevard, (2 acres), all of which is more particularly described herein (Proposal No. 2002Z-004G-13). The bill was disapproved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance amending Section 13.08.030 of the Metropolitan Code to prohibit construction, installation, operation, and maintenance on any encroachment in, on, over, or under any street, road, alley, sidewalk or other public way except by permit properly issued by Metropolitan Government. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance to amend the Metropolitan Code of Laws, Chapter 7.08 to permit the issuance of on-sale beer permits to performing arts facilities as defined. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer, Wine and Whiskey Committee by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the preliminary plan of the Planned Unit Development District located abutting the north margin of Old Hickory Boulevard and the east margin of Franklin Pike Circle, classified OR40 and CL Districts, (14.42 acres), to permit the development of three 6-story, 150,000 square foot office buildings and parking garages, and two, 8,000 square foot restaurants, replacing 130 condominium units, a 10 story, 250,000 square foot office building and two 8,000 square foot restaurants, all of which is more particularly described herein (Proposal No. 94P-009U-12). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. At the request of the sponsor, Mr. Turner moved to defer action on the bill, the bill being requested by Barge, Cauthen and Associates, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Commercial Planned Unit Development District located abutting the north margin of Lebanon Pike between Andrew Jackson Parkway and Shute Lane, classified SCR District, (23.06 acres), to permit the addition of 3.82 acres, classified CS District, and the development of a 203,622 square foot Wal-Mart Supercenter, and to relocate a 6,500 square foot Blockbuster video rental store, replacing a 111,713 square foot retail center, a 19,715 square foot theater, and a 6,503 square foot video rental store, all of which is more particularly described herein (Proposal No. 91-71-G-14). The bill was disapproved by the Planning Commission and approved by the Planning, Zoning and Historical Committee. Mr. Brown moved to defer action on the bill, the bill being requested by Carlson Consulting Engineers, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, Section 17.32.040 (Exempt Signs) pertaining to official government, fraternal, religious or civic flags (Proposal No. 2002Z-005T). The bill was approved by the Planning Commission. The Planning, Zoning and Historical Committee recommended deferment of the bill. Mr. Majors moved to defer action on the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS District to ORI District properties at 2219, 2305, 2401, 2405, 2409, and 2415 Charlotte Avenue, 340 23rd Avenue North, 345 24th Avenue North, and 310 25th Avenue North, east of Park Plaza, (2.47 acres), all of which is more particularly described herein (Proposal No. 2002Z-002U-10). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Whitmore moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: "Ayes" Ferrell, Waters, Briley, Gentry, Tucker, Gilmore, Black, Nollner, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, Greer, Hausser, Wallace, Haddox, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, Turner, Williams, Lineweaver (38); "Noes" (0).
