ORDINANCE NO. BL2002-984

An ordinance to amend the Metropolitan Code of Laws, Chapter 7.08 to permit the issuance of on-sale beer permits to performing arts facilities as defined.

WHEREAS, on premise beer permits are currently authorized to be issued to eating establishments where meals or lunches are regularly served; and

WHEREAS, it is in the best interest of the community that certain performing arts facilities located within the downtown commercial core be permitted to obtain an on-sale beer permit.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Section 7.089.010 of the Metropolitan Code of Laws be amended by inserting after the paragraph defining "Park" the following new definition:

"'Performing Arts Facility' means a facility owned by a governmental entity and administered by a not-for-profit corporation which facility is located within the Core Commercial District (CC) or Core Commercial Frame District (CF) as defined in Title 17 of this Code and in which meetings, festivals, live theatrical, musical, and other performances and events are regularly presented."

SECTION 2. That Section 7.08.100 of the Metropolitan Code of Laws be amended by deleting the following provisions of said section wherein they appear in the first sentence:

"Retailer on-sale beer permits shall not be issued except to eating establishments with"

and substituting in lieu thereof the following new provisions:

"Retailer on-sale beer permits shall not be issued except to Performing Arts Facilities or to eating establishments where such eating establishments possess"

SECTION 3. That this Ordinance shall take effect upon its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
