ORDINANCE NO. BL2002-969

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, Section 17.32.040 (Exempt Signs) pertaining to official government, fraternal, religious or civic flags (Proposal No. 2002Z-005T).

Whereas, the current zoning laws limit flags to those mounted on permanent poles attached to the ground or building; and

Whereas, it is deemed appropriate to allow flags to be displayed by other means;

NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY THAT:


SECTION 1. Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, Section 17.32.040 (H) is hereby amended as follows:

H. Official government, fraternal, religious or civic flags when mounted individually on permanent poles attached to the ground or building;

SECTION 2. This ordinance shall take effect five days from its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2002-969

Mr. President:

I move to amend Ordinance No. BL2002-969 by modifying it as follows:

Section 1. Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, Section 17.32.040 (H) is hereby amended as flows with items accordingly renumbered within this section:

H. Official government, fraternal, religious or civic flags when mounted individually on permanent poles attached to the ground or building;

I. Official government flags of the following governmental entities shall be the only official government flags recognized as such by the Metropolitan Government of Nashville and Davidson County:

a) the United States of America
b) any state, territory, or possession of the United States of America
c) any official flag adopted as such by the Metropolitan Government of Nashville and Davidson County
d) any official flag adopted by a member state of the United Nations
e) any official flag adopted by a sovereign nation, including Switzerland
