RESOLUTION NO. RS2002-983
A resolution authorizing the Department of Law to compromise and settle the lawsuit of Jason Parks against Charles Rutzky in the amount of $15,000, of which the Metropolitan Government shall contribute $12,500.
Whereas, plaintiff Jason Parks is a resident of Davidson County, Tennessee; and
Whereas, Mr. Parks was involved in an altercation with three Metropolitan police officers, including Charles Rutzky, at the Music City Mix Factory; and
Whereas, resulting from this altercation, Jason Parks incurred physical injuries; and
Whereas, Jason Parks filed
suit against the Metropolitan Government, Charles Rutzky, Neil Cook, and Philip
N. Clark; and
Whereas, all claims have
been dismissed against all defendants except Charles Rutzky; and
Whereas, Charles Rutzky
is still an employee of the Metropolitan Police Department.
Now therefore, be it resolved by the Council of The Metropolitan Government
of Nashville and Davidson County:
Section 1: That the Metropolitan
Department of Law is authorized to compromise and settle the lawsuit of Jason
Parks in the amount of ($15,000.00). Of this amount, Charles Rutzky will pay
$2,500 and The Metropolitan Government shall pay $12,500 from the Judgments
and Losses Fund.
Section 2: This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
