RESOLUTION NO. RS2002-939

A Resolution requesting the Metropolitan Department of Public Works to initiate a policy to reinstall residents' mailboxes knocked down as a result of traffic accidents, vandalism, or other unforeseen circumstances, which were originally installed into the sidewalk by the Department of Public Works.

WHEREAS, residents located in areas of Davidson County in which sidewalks are constructed by the Department of Public Works are required to furnish their own mailboxes; and

WHEREAS, it was at one time the policy of the Department of Public Works to install the residents' mailboxes into the concrete when constructing the sidewalks; and

WHEREAS, some residents' mailboxes that were originally installed in the sidewalk by the Department of Public Works have been or may in the future be knocked down as a result of traffic accidents, vandalism, or other unforeseen circumstances; and

WHEREAS, it is the current policy of the Department of Public Works that residents' whose mailboxes have been knocked down are responsible for reinstalling the mailboxes; and

WHEREAS, it is fitting and proper for the Metropolitan Department of Public Works to reinstall knocked down mailboxes that were originally installed into the sidewalk to insure that the mailboxes are safely and properly reinstalled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Department of Public Works to initiate a policy to reinstall residents' mailboxes knocked down as a result of traffic accidents, vandalism, or other unforeseen circumstances, which were originally installed into the sidewalk by the Department of Public Works.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the director of the Metropolitan Department of Public Works.

SECTION 3. That the director of the Metropolitan Department of Public Works is requested to inform the Metropolitan Council in writing of the feasibility of and/or actions taken in compliance with the request in Section 1 hereof not later that thirty (30) days after adoption of this Resolution.

SECTION 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
