RESOLUTION NO. RS2002-978

A resolution requesting the Metropolitan Planning Commission to report to the Metro Council on the implementation and effectiveness of the Urban Zoning Overlay.

WHEREAS, the Metro Council has enacted legislation amending Title 17 of the Metropolitan Code to provide for an Urban Zoning Overlay which purposes were to enhance development of property in the urban downtown area of the Metropolitan Government that closely resemble the old Metropolitan Nashville; and

WHEREAS, it is appropriate that the Metro Planning Commission report to the Metro Council on the implementation and effectiveness of this overlay and the benefits, if any, which have been provided to the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Planning Commission to report to the Metro Council on the implementation and effectiveness of the Urban Zoning Overlay.

SECTION 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to the Executive Director of the Metropolitan Planning Commission.

SECTION 3. That the Executive Director of the Metropolitan Planning Commission is further requested to inform The Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 hereof, not later than one hundred eighty (180) days after the adoption of this Resolution. The Planning Commission is further requested to provide the Metro Council with periodic updates on the implementation and effectiveness of the Urban Zoning Overlay.

SECTION 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
