Metropolitan Council Meeting
Tuesday, August 21, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Leo Waters.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of August 7, 2001 were approved.

- ELECTIONS AND CONFIRMATIONS -

Auditorium Commission

Appointment of Ms. Anne-Marie Farmer to the Auditorium Commission for a term expiring June 30, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Access Television Corporation Board

Reappointment of Ms. Marcie Smeck to the Community Access Television Corporation Board for a term expiring October 10, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Convention Center Commission

Reappointment of Mr. Cyrus Booker to the Convention Center Commission for a term expiring June 7, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transportation Licensing Commission

Reappointment of Ms. Sammye Woods to the Transportation Licensing Commission for a term expiring October 10, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

President Pro Tem

The President called for nominations for President Pro Tem of the Metropolitan Council for a one-year term expiring August 31, 2002. Ms. Balthrop nominated Mr. Gentry, which motion was seconded. Mr. Wallace moved that nominations cease and that Mr. Gentry be elected by acclamation, which motion was seconded and adopted by a unanimous vote of the Council. The President declared the election of Mr. Gentry as President Pro Tem of the Council for a one-year term expiring August 31, 2002.

Planning, Zoning and Historical Committee Chair

The President called for nominations to elect a chair of the Planning, Zoning and Historical Committee for a two-year term expiring August 31, 2003. Mr. Ponder nominated Ms. Gilmore, which motion was seconded; Mr. Shulman nominated Mr. Summers, which motion was seconded. Mr. Whitmore moved that nominations cease, which motion was seconded and adopted without objection. A ballot was taken, and the Clerk confirmed the vote as follows:

Traffic and Parking Committee Chair

The President called for nominations to elect a chair of the Traffic and Parking Committee for a two-year term expiring August 31, 2003. Mr. Black nominated Mr. Brown, which motion was seconded. Mr. Dillard nominated Mr. Lineweaver, which motion was seconded; Mr. Lineweaver subsequently withdrew his name from the ballot. Mr. Ponder moved that nominations cease and that Mr. Brown be elected by acclamation, which motion was seconded and adopted by a unanimous vote of the Council. The President declared the election of Mr. Brown for a two-year term expiring
August 31, 2003.

Council Audit Committee

The President called for nominations to fill two Council member seats on the Council Audit Committee for a one-year term ending August 31, 2002. Mr. Jenkins nominated Mr. Waters for one seat; Mr. Waters nominated Mr. Jenkins for one seat. Mr. Ferrell moved that nominations cease and that Councilmembers Jenkins and Waters be elected by acclamation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2001-692

A resolution requesting the Director of Public Property Administration to introduce for adoption appropriate legislation to condemn the property located at the corner of Second Avenue and Union Street, adjacent to the Stahlman Building. The Budget and Finance Committee made no recommendation on the resolution. A resolution authorizing Faison's, Inc. and John M. A resolution proclaiming the weekend of August 24th through August 26th, 2001, as the first annual "Mix 92.9 Radiothon" for Vanderbilt Children's Hospital. A resolution requesting the Mayor, the Chief of Police and the Fire Chief to identify vehicles which they recommend should be equipped with video cameras, and provide an estimate of the cost to the Metropolitan Government. RESOLUTION NO. RS2001-708

A resolution requesting the Mayor and the Director of Finance to provide the Metropolitan Council with the financial information relative to the ability to reduce the property tax rate if an increase in the Metro city motor vehicle sticker is adopted. The Budget and Finance Committee recommended indefinite deferment of the resolution. Mr. Wallace moved to defer action indefinitely on the resolution, which motion was seconded and adopted by a voice vote of the Council.

A resolution approving an Amendment No. 1 to the Grant Agreement from the State of Tennessee, Department of Health, to the Metropolitan Government, by and through the Metropolitan Board of Health, which amendment increases the grant for immunization services for children and adults and for the control of vaccine-preventable diseases to an amount not to exceed $389,000. A resolution approving an Amendment No. 1 to the Contract, which amendment increases the amount of the grant in an amount not to exceed $180,000 per year from the State of Tennessee, Department of Agriculture, to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Board of Health, for the inspection, reporting and enforcement of retail food stores in Davidson County. RESOLUTION NO. RS2001-715

A resolution approving an EPA Cooperative Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, Pollution Control Division, and the U.S. Environmental Protection Agency, for a study to determine ambient concentrations of hazardous air pollutants at two sites in Nashville, Davidson County, Tennessee. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees. RESOLUTION NO. RS2001-718

A resolution authorizing Marianne W. Bingham to install, construct and maintain a sign measuring 12'0" in length, 2'2" in width, and 28'2" in total height 14' above the public sidewalk at 412 Broadway (Proposal No.2001M-080U-09), all of which is more particularly described herein. Mr. Wallace offered a substitute resolution and moved that it be accepted for filing and no objection was made.

SUBSTITUTE RESOLUTION NO. RS2001-718

A substitute resolution authorizing Marianne W. Bingham and Ruble Sanderson of "The Stage at Broadway", the lessee of 412 Broadway, to install, construct and maintain a sign measuring 12'0" in length, 2'2" in width, and 28'2" in total height 14' above the public sidewalk at 412 Broadway (Proposal No.2001M-080U-09), all of which is more particularly described herein. The resolution was disapproved by the Planning Commission; the Public Works Committee recommended deferment and the Planning, Zoning and Historical Committee approved and recommended deferment. Mr. Wallace moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-812

An ordinance establishing a program for the purpose of providing assistance to low-income elderly residents of the Metropolitan Government for the fiscal year 2001-2002. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2001-813

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of the new W. H. Oliver Middle School and a future elementary school in the Nolensville Road area. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Education and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-814

An ordinance authorizing the sale of certain property described herein (part of Parcel 5, Tax Map 51) located on Chadwell Drive, east of Interstate 65, to the State of Tennessee in conjunction with the construction of Project No. 19012-2152-44. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

An ordinance authorizing the Metropolitan Government to accept certain real property from First Baptist Church. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-816

An ordinance authorizing the Director of Public Property, or his designee, to accept and record easements in favor of the Metropolitan Government, for the use and benefit of the Greenway Commission, on certain parcels of property for use in the greenway system. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Parks, Library, Recreation and Auditorium and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-819

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by renaming portions of McCrory Creek Road and Couchville Pike; and by naming an unnamed road, (Proposal No. 2000M-108U-13), all of which is more particularly described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, E-911 Board, Public Works, Traffic and Parking and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2001-820

An ordinance amending Title 17 of the Metropolitan Code, the zoning code for Metropolitan Nashville and Davidson County, by amending Section 17.40.600 by authorizing the zoning administrator to act immediately regarding violations of Title 17 of the Metropolitan Code which concern the public health, safety and welfare of the citizens of Davidson County, Tennessee and to notify the landowner or the operator as to violations of Title 17 of the Metropolitan Code. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2001-821

An ordinance amending Title 17 of the Metropolitan Code, the zoning code for Metropolitan Nashville and Davidson County, by amending Section 17.40.520 to require individuals or entities seeking to construct or alter a structure or initiate a change in the use of property to file an application for a zoning permit. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
