ORDINANCE NO. BL2001-778

An ordinance to amend Title 15.60.180(I) to include a surcharge for ammonia.

WHEREAS, members of the Metropolitan Hearing Authority, as authorized by Metropolitan Code of Laws, 15.60.350, by action at the April meeting, requested the staff of Metro Water Services develop a surcharge for ammonia; and

WHEREAS, levels of ammonia above the allowable limits increase the operational costs of the wastewater treatment plant's removal process; and

WHEREAS, it was determined that a surcharge for ammonia can be developed based upon the costs to treat biological oxygen demand (BOD).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Code of Laws, Section 15.60.180(I)(3) shall be replaced and substituted with the following:

3. Such charge for the BOD, ammonia, suspended solids, and oil and grease will be computed using the following formula:

Surcharge ($)/P = 8.34 X (F) X (TC) X (Pa-Pm)
Surcharge ($) total = Surcharges of BOD5 + ammonia + suspended solids and grease.
P---Parameter: BOD5 or ammonia or suspended solids or grease.
F---Flow in millions of gallons per day.
TC---Treatment costs for servicing POTW per pound of parameter. Ammonia's surcharge will be 4.6 times the rate for BODs.
Pa---Parameter, actual.
Pm---Parameter, maximum.

SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
