ORDINANCE NO. BL2001-779

An ordinance authorizing Winchester Development LLC, hereinafter known as "WINCHESTER" to participate with the Metropolitan Government, Department of Water and Sewerage Services, hereinafter known as "METRO" for the construction of Project Nos. 97-SG-84, Owl Creek Trunk Sewer and 99-SL-212, South Springs at Southern Woods West.

WHEREAS, METRO provides sewerage service in Williamson County; and

WHEREAS, WINCHESTER has expressed a desire to provide improved public sewer service in northeast Williamson County, TN, hereinafter known as South Springs @ Southern Woods West; and

WHEREAS, METRO has funded and built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000 per connection as basin fees; and

WHEREAS, it is deemed to benefit both parties and the general community by WINCHESTER agreeing to pay a total cost of $36,000 for 18 connections; and

WHEREAS, this work is identified in METRO's Capital Improvements Budget as Project No. 96SG0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That METRO is hereby authorized to accept from WINCHESTER $36,000 as a contribution toward financing of the construction of the Owl Creek Trunk Sewer Project No. 97-SG-84.

SECTION 2: That future amendments to this agreement shall be approved by Resolution, adopted by the Metropolitan Council.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
