An ordinance amending Chapter 3.16 regarding employee pension contributions.

Whereas, the Metropolitan Board of Education has decided to reallocate money appropriated to employee pay raises to assuming the employee pension contributions for its employees that participate in the Metropolitan Employee Benefit System; and
Whereas, the Metropolitan Employee Benefit Board has approved this change; and

Whereas, implementing this change requires an amendment to Chapter 3.16 of the Metropolitan Code of Laws; and

Whereas, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that Chapter 3.16 be amended,

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, that:

Section 1: Section 3.16.010(A) is hereby deleted in its entirety and the following language substituted:
Contributions by members to the system who are eligible employees shall include medical care contributions and dental care contributions. Such contributions shall be payable in accordance with this chapter. Contributions by members shall be paid by payroll deductions. The financial requirements of the system for all benefits, including pension benefits, disability benefits, life insurance benefits and medical care benefits or services shall be determined by the board in accordance with this chapter. Pension contributions shall be paid into Fund B or Fund C as the case may be. Life insurance contributions and medical care contributions shall be paid into the insurance account.

Section 2: Section 3.16.030(H) is hereby deleted in its entirety and the following language substituted:
The provisions of subsections D through G of this section shall not apply to employees of the metropolitan board of education prior to July 1, 2001. From and after July 1, 2001 subsections D through G of this section shall apply to employees of the metropolitan board of education who are members of the metropolitan employee benefit system and any funds deducted from employee pay for employee contributions for pensions from and after July 1, 2001 shall be refunded to the effected employees. In applying subsections D through G of this section to employees of the metropolitan board of education, "July 1, 2001" shall be substituted for "January 1, 1987" and "metropolitan board of education" shall be substituted for "metropolitan government" wherever appearing in said subsections. Nothing in this subsection shall be construed to effect any employee pension contributions prior to July 1, 2001.

Section 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
