ORDINANCE NO. BL2001-780

An ordinance authorizing Duke-Weeks Realty LP, hereinafter known as "DUKE-WEEKS" to participate with the Metropolitan Government, Department of Water and Sewerage Services, hereinafter known as "METRO" for the construction of Project No. 01-SL-85, Airpark East Business Park.

WHEREAS, METRO provides sewerage service in Davidson County; and

WHEREAS, DUKE-WEEKS has expressed a desire to provide a public sewer extension in Davidson County, TN, hereinafter known as Airpark East Business Park located at Couchville Pike & Reynolds Rd.; and

WHEREAS, DUKE-WEEKS desires to construct a public sewer pump station and public force main to serve the Airpark East Business Park in lieu of constructing a gravity trunk sewer extension; and

WHEREAS, the sewer pump station & force main is deemed to directly benefit DUKE-WEEKS only and DUKE-WEEKS is agreeable to paying the amount of $221,500 as additional costs; and

WHEREAS, this work is identified in METRO's Capital Improvements Budget as Project No. 96SG0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That METRO is hereby authorized to accept from DUKE-WEEKS the amount of $71,500. for 143 units @ $500. each as additional capacity fees for pumping from the McCrory Creek Basin to the Smith Springs Basin.

SECTION 2: That METRO is hereby authorized to accept from DUKE-WEEKS the amount of $150,000 for the future operation and maintenance of the pump station.

SECTION 3: That future amendments to this agreement shall be approved by Resolution, adopted by the Metropolitan Council.

SECTION 4: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
