An ordinance authorizing the Director of Parks and Recreation, or his designee, to accept, execute and record an agreement for grant of an easement (Nashville Mill Run Homeowners Assocation) on a parcel of property for use in the greenway system.

Whereas, pursuant to the terms of the document attached as Exhibit A to this ordinance, Mill Run, LLC, and Nashville Mill Run Homeowners Association have agreed to donate to the Metropolitan Government an easement on a certain parcel of property abutting Mill Creek; and

Whereas, the easement will be used to construct, operate and maintain portions of the greenway system; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of Parks and Recreation, or his designee, is authorized to accept, execute and record the agreement for dedication of easement (Exhibit A).

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
