An ordinance approving an agreement by and between The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, and the City of Ridgetop for the provision of wastewater treatment services and voiding the May 20, 1997 service agreement.

WHEREAS, The Metropolitan Government of Nashville and Davidson County is authorized to provide wastewater treatment services both inside and outside the territorial boundaries of Davidson County; and

WHEREAS, the Department of Water and Sewerage Services is both authorized and required to provide wastewater treatment throughout the area known as the 201 Wastewater Area; and

WHEREAS, the City of Ridgetop desires that the Department of Water and Sewerage Services provide wastewater treatment services to the City and agrees to pay the applicable commercial rate for such services; and

WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that an agreement between the Metropolitan Government and the City of Ridgetop whereby the Department of Water and Sewerage Services provides wastewater treatment service to the City of Ridgetop be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the agreement by and between The Metropolitan Government of Nashville and Davidson County and the City of Ridgetop, a copy of which is attached hereto and incorporated herein, be approved and the Metropolitan Mayor is authorized to execute said agreement on behalf of the Metropolitan Government.

SECTION 2: That the existing May 20, 1997 agreement with the City of Ridgetop and Bill No. 97-724, approving this agreement, are voided.

SECTION 3: That any amendment to the agreement may be approved by a resolution of the Metropolitan Council which receives at least twenty-one affirmative votes.

SECTION 4: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
