ORDINANCE NO. BL2001-815

An ordinance authorizing the Metropolitan Government to accept certain real property from First Baptist Church.

Whereas, the Metropolitan Government of Nashville and Davidson County ("the Metropolitan Government") desires to make certain improvements at the intersection of Demonbreun Street and Seventh Avenue South; and

Whereas such improvements will be enhanced and facilitated by the conveyance of certain real property from First Baptist Church to the Metropolitan Government; and

Whereas, First Baptist Church desires to convey said property to the Metropolitan Government in fee simple,

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Metropolitan Government is authorized to accept, and pursuant to this ordinance does hereby accept, conveyance of that property indicated on the attached exhibit in fee simple from First Baptist Church.

Section 2. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
