ORDINANCE NO. BL2001-787

An ordinance authorizing the Metropolitan Government to accept a consent to easement from the U.S. Army Corps of Engineers.

Whereas, the Metropolitan Government of Nashville and Davidson County ("the Metropolitan Government) is in need of an easement from the U.S. Army Corps of Engineers ("the Corps") for the purpose of maintaining the Shelby Street Bridge; and

Whereas, the Corps is willing to grant to the Metropolitan Government consent to easement for said purpose; and

Whereas, it is in the best interests of the Metropolitan Government to accept a consent to easement,

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The attached consent to easement with the Corps is approved; and the Metropolitan Mayor is authorized to execute said easement.

Section 2. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
