ORDINANCE NO. BL2001-813

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of the new W. H. Oliver Middle School and a future elementary school in the Nolensville Road area.

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to "…purchase…or otherwise acquire…property…for any public purpose."; and

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government "to establish, maintain and regulate…a system of free schools…"; and

WHEREAS, it is in the public interest that certain property, identified as Parcel 94 on Tax Map 172, be acquired through negotiation or condemnation for the construction of the new W. H. Oliver Middle School and a future elementary school in the Nolensville Road area; and

WHEREAS, the Metropolitan Board of Education approved the acquisition of said property at its meeting on July 10, 2001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire, by negotiation or condemnation, property for the purpose of constructing, maintaining and operating the new W. H. Oliver Middle School and a future elementary school in the Nolensville Road area.

SECTION 2. The Director of Public Property Administration, or his designee, is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the property shown on Exhibit A and identified as Parcel 94 on Tax Map 172.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
