Metropolitan Council Meeting
Tuesday, June 3, 2014


The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Nicholas Calvin a 2014 East Magnate High School graduate.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Steine, Garrett, Tygard, Maynard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Pardue, Glover, Stites, Stanley, Claiborne, Tenpenny, Moore, Allen, Gilmore, Baker, Weiner, Evans, McGuire, Holleman, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Duvall, Todd, Mitchell and Neighbors (39); Absent: Langster (1).

The Minutes of the regular meeting of May 20, 2014, were approved.

- PROPOSED RULES AMENDMENT -

The following proposed amendment to the Rules of Procedure of the Metropolitan Council was distributed and will be considered at the next regular meeting of Council:

The 2011-2015 Rules of Procedure of the Council of the Metropolitan Government of Nashville and Davidson County (as amended) are hereby amended by deleting Rule 12 in its entirety and substituting with the following new Rule 12:

12. Zoning Public Hearings

Public hearings on zoning bills shall be held at the first meeting of each month, provided that no zoning public hearing shall be held at the first meeting in June. This rule shall not preclude any other matters from being considered on the first meeting of each month.

- ELECTIONS AND CONFIRMATIONS -

Fire and Building Code Appeals Board
Appointment of Mr. John Finch for a term expiring March 1, 2018. Mr. Campbell will fill the unexpired term of Mr. Thomas Lipscomb. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education, Community and Arts Television Corporation (NECAT)
Reappointment of Ms. Jennifer Buck-Wallace for a term expiring May 5, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Appointment of Ms. Jessica Farr for a term expiring March 31, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Transit Authority
Reappointment of Mr. Jeff Yarbro for a term expiring June 1, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Councilmember Barry moved that at the time of adjournment the Council adjourn to Tuesday, June 10, 2014, at 6:00 p.m. for the purpose of considering Ordinance No. BL2014-788, the Capital Improvements Budget for fiscal year 2015, on third and final reading along with any other matters the Vice Mayor deems appropriate for consideration at that time.

BILL NO. BL2014-774

A bill to be entitled: The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2015. Mr. Steine requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Steine moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-788

An ordinance adopting the Capital Improvements Budget and Program 2014-2015 through 2019-2020 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2014-2015. The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees. Mr. Steine requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in opposition to passage of the bill. The President declared the public hearing closed. Mr. Steine moved to pass the bill on second reading and re-refer the bill to the Budget and Finance and Planning, Zoning and Historical Committees, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-392

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to RS80 zoning for property located at Sawyer Brown Road (unnumbered), approximately 540 feet north of Meadow Lane Drive (39.09 acres), all of which is described herein (Proposal No. 2013Z-008PR-001). Mr. Tygard moved to defer the bill to the July public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-747

An ordinance amending Chapters 17.04, 17.08 and 17.16 of the Metropolitan Code to add a definition and conditions of “Communications Hut.” (Proposal No. 2014Z-013TX-001). The bill was approved by the Planning Commission. Mr. Hunt requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Hunt moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-759

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to SP zoning for properties located at 610 Merritt Avenue, 1234, 1236 and 1238 Martin Street, approximately 200 feet east of Hagan Street (7.3 acres), to permit a mixed-use development, all of which is described herein (Proposal No. 2014SP-016-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Moore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. Ms. Moore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-760

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CN to MUN-A zoning for property located at 5916 Morrow Road, at the northeast corner of Morrow Road and 60th Avenue North (0.16 Acres), all of which is described herein (Proposal No. 2014Z-023PR-001). The bill was approved by the Planning Commission. Mr. Baker requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS20 to RS30 zoning for properties located at 3914, 3916, 3920, 4002, 4004, 4008, 4010, 4016 and 4128 Wallace Lane, south of Abbott Martin Road (approximately 11 acres), all of which is described herein (Proposal No. 2014Z-036PR-001). The bill was approved by the Planning Commission. Mr. Todd requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Todd moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-762

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for properties located at 1007 and 1009 N. 5th Street, approximately 185 feet north of Vernon Winfrey Avenue (0.36 acres), to permit up to 4 detached dwelling units, all of which is described herein (Proposal No. 2014SP-021-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Davis filed documents in favor of the bill for the record. Mr. Davis moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-763

An ordinance to amend Ordinance No. BL2005-688 for property located at 3101 Nolensville Pike, at the southwest corner of Nolensville Pike and McIver Street, zoned CS (1.1 acres), to remove a section of Amendment #1 in Council Bill BL2005-688 that states that "No signage shall be allowed other than that currently in existence and is located upon the brick building", all of which is described herein (Proposal No. 2005P-009-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Tenpenny requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Tenpenny moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-764

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Neighborhood Landmark Overlay District to property located at 1627 Shelby Avenue, at the northwest corner of Shelby Avenue and S. 17th Street, (0.11 acres), zoned R6, all of which is described herein (Proposal No. 2014NL-002-001). The bill was approved by the Planning Commission. Mr. Westerholm requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-765

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to SP zoning for properties located at 302 Taylor Street, 1408 and 1410 4th Avenue North and 1401 and 1403 3rd Avenue North, south of Van Buren Street (2.43 Acres), to permit up to 249 multifamily dwelling units and all uses permitted by the MUL-A zoning district, all of which is described herein (Proposal No. 2014SP-020-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2014-766

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RS10 zoning for various properties located along Cedar Hill Road, Crosby Lane, Cypress Drive, Fairlane Drive, Gillette Road, Madeline Drive, Melpar Drive, Packard Drive, Pearson Place, Raywood Lane, Strasser Drive, Tusculum Road, Yorktown Road and a portion of property located at 4930 Nolensville Pike, on the east side of Nolensville Pike (approximately 156 acres), all of which is described herein (Proposal No. 2014Z-021PR-001). The bill was disapproved by the Planning Commission, approved with substitute. Mr. Potts requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. BILL NO. BL2014-767

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Mansion at Fontanel Specific Plan District for properties located at 4105, 4125, and 4225 Whites Creek Pike, approximately 1,000 feet north of Lloyd Road (136.04 acres) and located within the Floodplain Overlay District, to add approximately 1.97 acres into the SP (from approximately 136.04 acres to 138.01 acres total), relocate a private drive, increase the total number of resort rooms from 140 to 150, and amend various limitations for the Seasonal Performance Entertainment Venue, all of which is described herein (Proposal No. 2009SP-022-008). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Hunt requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2014-772

An ordinance amending Chapter 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations to modify the conditions pertaining to lot size, setbacks, street standard, landscaping, and hours of operation for construction/demolition landfills and recycling facilities (Proposal No. 2014Z-015TX-001). Mr. Tygard moved to defer the bill to the July public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-773

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CF and ORI to SP zoning for properties located at 1, 7, 9 and 11 Music Square West, at the corner of Division Street and 17th Avenue South (1.05 acres), to permit a mixed use development, all of which is described herein (Proposal No. 2014SP-037-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, to create the Music City Cultural Heritage Overlay District, and to apply such Overlay District to approximately 17.22 acres of property located on Broadway, Second Avenue North, and Printer’s Alley, all of which is more particularly described herein (Proposal No. 2014Z-016TX-001). The bill was disapproved by the Planning Commission. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1107

A resolution appropriating $1,089,500 in Community Development Block Grant funds for sidewalk improvements in North Nashville. The resolution was approved by the Budget and Finance and Federal Grants Review Committees.

RESOLUTION NO. RS2014-1108

A resolution accepting a donation from Sue Ann Jennings to the Mayor’s Office of Emergency Management. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1110

A resolution approving an amendment to an agreement between The Metropolitan Government of Nashville and Davidson County and Hospital Corporation of America (“HCA”) concerning the exchange of certain parcels of real estate and construction of a new public health center. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1111

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide HIV/AIDS prevention, surveillance, and sexually transmitted disease program services. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1112

A resolution approving Amendment Nine to a grant from the United States Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for the ongoing collection of data on ambient air concentrations for fine particulate matter in Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1113

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to facilitate the planning, implementation, and evaluation of community-driven and evidence-based health promotion programs to Davidson County residents. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1114

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to support the delivery of public health services.
The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1115

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide tuberculosis control, prevention, and outreach services. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1116

A resolution approving Amendment Ten to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to protect air quality to achieve established ambient air standards and protect human health. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1117

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and The University of Tennessee Extension Expanded Food and Nutrition Education Program (EFNEP) to perform activities related to the Project Diabetes Golden Sneaker Initiative Program. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1118

A resolution approving an intergovernmental license agreement with the State of Tennessee, Department of Transportation, for the use and benefit of the Board of Parks and Recreation in the construction and maintenance of a pedestrian crossing at Edwin Warner Park (Proposal No. 2014M-002OT-001). The resolution was approved by the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1119

A resolution accepting a grant from the Tennessee State Library and Archives to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to target library materials to persons having difficulty using a library and to the underserved in the Nashville – Davidson County area. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1120

A resolution approving Amendment Seven to a grant from Vanderbilt University Medical Center, acting by and through the Vanderbilt Department of Pediatrics, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to collaborate on the Growing Right Onto Wellness (GROW) project to stop obesity in preschoolers before it becomes problematic. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1121

A resolution accepting a grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Sheriff’s Office, to reduce litter along county, state, and interstate highways within Davidson County. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1122

A resolution approving an application for the Bulletproof Vest Partnership Grant from the United States Department of Justice to The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1124

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government of Nashville and Davidson County’s subrogation claim for the in-the-line-of-duty injury benefits paid on behalf of employee, Viva L. Farlow, in the amount of $19,500.00. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1125

A resolution recognizing the Americans for the Arts Annual Convention to be held in Nashville on June 13-15, 2014, and proclaiming June 13-15 as Arts Leadership Weekend throughout Nashville. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

Amendment No. 1. The Charter Revision Commission and the Charter Revision Committee approved the amendment. RESOLUTION NO. RS2014-1109

A resolution to establish a new application fee for a contextual overlay (Proposal No. 2014Z-017TX-001). The resolution was approved by the Planning Commission; the Budget and Finance Committee recommended deferment. Mr. Hunt moved to defer the resolution to the first meeting in July, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-1123

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Brandii Brown against the Metropolitan Government of Nashville and Davidson County in the amount of $15,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee with an amendment. Mr. Steine offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council.
