RESOLUTION NO. RS2014-1123

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Brandii Brown against the Metropolitan Government of Nashville and Davidson County in the amount of $15,000.00, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on March 18, 2013, Brandi Brown was traveling on I-24 West when she stopped her vehicle because traffic in front of her was not moving. Ms. Brown’s vehicle was struck in the rear by a patrol car driven by a Metropolitan Nashville Police Department employee, causing personal injury to her; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the personal injury claim of Brandii Brown be compromised and settled for a total of $15,000.00 and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Brandii Brown for the sum of $15,000.00 with said amount to be paid out of the Self- Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Resolution No. RS2014-1123

Madam President:

I move to amend Resolution No. RS2014-1123 by deleting Section 2 in its entirety and replacing it with the sections set out below. This amendment is being made to correct an erroneous settlement amount previously approved pursuant to Resolution No. RS2014-1027.

Section 2: The provisions of Resolution No. RS2014-1027 which purported to settle the claim of Brandi Brown are hereby declared to be null and void.

Section 3: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
