ORDINANCE NO. BL2014-753

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 420 linear feet of eight inch water main, approximately 395 linear feet of 10 inch sewer main, and approximately 330 linear feet of eight inch sewer main for properties located at 419 Jefferson Street, 1023 4th Avenue North, 0 Fifth Avenue North, and 1007 4th Avenue North, (MWS Project Nos. 14-WL-11 and 14-SL-12 and Proposal No. 2014M-016ES-001).

WHEREAS, the abandonment of approximately 420 linear feet of eight inch water main, approximately 395 linear feet of 10 inch sewer main, and approximately 330 linear feet of eight inch sewer main for properties located at 419 Jefferson Street, 1023 4th Avenue North, 0 Fifth Avenue North, and 1007 4th Avenue North are needed to construct MWS Projects 14-WL-11 and 14-SL-12; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-016ES-001 on March 7, 2014, for the abandonment of said water and sewer mains.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 420 linear feet of eight inch water main, approximately 395 linear feet of 10 inch sewer main, and approximately 330 linear feet of eight inch sewer main for properties located at 419 Jefferson Street, 1023 4th Avenue North, 0 Fifth Avenue North, and 1007 4th Avenue North, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonments authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
