ORDINANCE NO. BL2014-778

An ordinance amending Chapter 10.60 of the Metropolitan Code to transfer the administration and personnel regarding the registration of burglar and fire alarms systems and the Board of Alarm Appeals from the Metropolitan Clerk’s Office to the Department of Codes Administration.

WHEREAS, the alarm registration ordinance was enacted to reduce the number of false alarms; and,

WHEREAS, registration creates a database for emergency personnel to know where alarm systems are located and who to contact in case of alarm activation; and,

WHEREAS, the Metropolitan Government Department of Codes Administration is more appropriately equipped to support and administer the provisions of this program; and,

WHEREAS, an amendment to Chapter 10.60 of the Metropolitan Code to effectuate a transfer from Metropolitan Clerk’s Office to the Department of Codes Administration is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 10.60.020 of the Metropolitan Code is hereby amended by deleting all references to the “metropolitan clerk” or the “metropolitan clerk’s office” and substituting with the “Department of Codes Administration”.

Section 2. Section 10.60.080 of the Metropolitan Code is hereby amended by deleting all references to the “metropolitan clerk” or the “metropolitan clerk’s office” and substituting with the “Director of Codes Administration or his duly authorized representative”.

Section 3. The employee position within the Metropolitan Clerk’s Office responsible for the administrative functions associated with the registration of alarm systems is hereby transferred to the Department of Codes Administration.

Section 4. Any provision of any ordinance of the Metropolitan Government of Nashville and Davidson County which conflicts, in whole or in part, with any provision of this ordinance is hereby repealed to the extent such conflict exists.

Section 5. Should any court of competent jurisdiction declare any section, clause or provision of this Ordinance to be unconstitutional, illegal or unenforceable for any other reasons, such decision shall affect only such section, clause or provision so declared unconstitutional, illegal or unenforceable and shall not affect any other section, clause or provision of this Ordinance, it being the intent of the Metropolitan Council that all other provisions of this Ordinance remain in full force and effect.

Section 6. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
