RESOLUTION NO. RS2014-1124

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government of Nashville and Davidson County’s subrogation claim for the in-the-line-of-duty injury benefits paid on behalf of employee, Viva L. Farlow, in the amount of $19,500.00.

WHEREAS, on October 21, 2011, Viva L. Farlow, an employee of the Metropolitan Government, was injured while in the course and scope of her employment when a vehicle driven by Ronald Cohen rolled backwards and hit the vehicle driven by Ms. Farlow causing her personal injury; and,

WHEREAS, Viva L. Farlow filed a lawsuit against Ronald Cohen pertaining to her injuries; and,

WHEREAS, the Metropolitan Government has a subrogation interest in the lawsuit relating to the in-the-line-of-duty medical and wage benefits paid to Viva Farlow; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the Metropolitan Government accept $19,500.00 in satisfaction of its claim.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its claim for damages for the sum of $19,500.00.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
