ORDINANCE NO. BL2014-790

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County, Department of Information Technology Services (“ITS”), to accept as a donation eight laptops from Dell, Inc. (“Dell”).

WHEREAS, section 2.01 of the Metropolitan Charter authorizes the Metropolitan Government to accept or refuse gifts, donations, bequests or grants from any source for any purpose related to the powers and duties of the Metropolitan Government; and,

WHEREAS, Ordinance No. BL2006-1015, as amended, requires that donations to the Metropolitan Government in excess of $5,000 be approved by the Metropolitan Council by ordinance; and,

WHEREAS, in response to solicitation RFP #364416, which was an invitation to bid issued to award contract(s) to selected vendor(s) to provide personal computers, Dell loaned ten laptop computers to ITS for the 120 day duration required by the RFP for testing; and,

WHEREAS, subsequent to the end of the test period, ITS was informed by Dell that the company’s standard policy is to write off demo equipment that is scheduled to be retained for a test period over 60 days in duration; and,

WHEREAS, Dell wishes to donate and ITS wishes to accept four Dell Latitude XT3 Convertible computers, valued at $1,354.98 each, and four Dell Latitude 10 Tablet computers, valued at $781.56, for a total value of $8,546.16.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the donation of personal computers from Dell, valued in the amount of eight thousand five hundred forty-six and 16/100 dollars ($8,546.16), is hereby accepted.

Section 2. That such accepted personal computers shall be appropriated to the Department of Information Technology Services for the use and benefit of The Metropolitan Government of Nashville and Davidson County.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
