ORDINANCE NO. BL2014-755

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 95 linear feet of an existing 36 inch combination sewer main and to accept approximately 114 linear feet of a 42 inch combination sewer main for property located at 1406 Holly Street, (MWS Project No. 14-SL-14 and Proposal No. 2014M-017ES-001).

WHEREAS, the abandonment of approximately 95 linear feet of an existing 36 inch combination sewer main and the acceptance of approximately 114 linear feet of a 42 inch combination sewer main for the property located at 1406 Holly Street is needed to construct MWS Project 14-SL-14; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-017ES-001 on March 7, 2014, for the abandonment and acceptance of said sewer mains.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 95 linear feet of an existing 36 inch combination sewer main and to accept approximately 114 linear feet of a 42 inch combination sewer main for property located at 1406 Holly Street, as listed below and shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
