ORDINANCE NO. BL2014-793

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 620 linear feet of existing eight inch public sewer main and easement, to accept approximately 838 linear feet of eight inch public sewer main and easement, to replace approximately 110 linear feet of eight inch public sewer main with 10 inch D.I.P. public sewer main, and to accept two public fire hydrant assemblies for properties located at 2033, 4000, and 4002 Hillsboro Pike and 2035 Richard Jones Road, (MWS Project Nos. 14-SL-20 and 14-WL-16 and Proposal No. 2014M-023ES-001).

WHEREAS, the abandonment of approximately 620 linear feet of existing eight inch public sewer main and easement, the acceptance of approximately 838 linear feet of eight inch public sewer main and easement, the replacement of approximately 110 linear feet of eight inch public sewer main with 10 inch D.I.P. public sewer main, and the acceptance of two public fire hydrant assemblies for properties located at 2033, 4000, and 4002 Hillsboro Pike and 2035 Richard Jones Road are needed to construct MWS project numbers 14-SL-20 and 14-WL-16; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-023ES-001 on April 21, 2014, for the abandonment and acceptance of said sewer mains, easements, and fire hydrants.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 620 linear feet of existing eight inch public sewer main and easement, to accept approximately 838 linear feet of eight inch public sewer main and easement, to replace approximately 110 linear feet of eight inch public sewer main with 10 inch D.I.P. public sewer main, and to accept two public fire hydrant assemblies for properties located at 2033, 4000, and 4002 Hillsboro Pike and 2035 Richard Jones Road, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
