ORDINANCE NO. BL2014-792

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 447 linear feet of an existing eight inch public sewer main and existing easement, to construct approximately 178 linear feet of eight inch sewer main, and to relocate approximately 20 linear feet of six inch water main for properties located at 415 27th Avenue North, 27th Avenue North (unnumbered), and 28th Avenue North (unnumbered), (MWS Project Nos. 14-SL-25 and 14-WL-19 and Proposal No. 2014M-021ES-001).

WHEREAS, the abandonment of approximately 447 linear feet of an existing eight inch public sewer main and existing easements, the construction of approximately178 linear feet of eight inch sewer main, and the relocation of approximately 20 linear feet of six inch public water main for properties located at 415 27th Avenue North, 27th Avenue North (unnumbered), and 28th Avenue North (unnumbered) are needed to construct MWS project numbers 14-SL-25 and 14-WL-19; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-021ES-001 on March 26, 2014, for the abandonment, acceptance, and relocation of said sewer and water mains and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 447 linear feet of an existing eight inch public sewer main and easement, to accept approximately 178 linear feet of eight inch public sewer, and to relocate 20 linear feet of public water main for properties located at 415 27th Avenue North, 27th Avenue North (unnumbered), and 28th Avenue North (unnumbered), as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, acceptance, and relocation authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
