ORDINANCE NO. BL2014-785

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire property through negotiations, condemnation, or fee simple take, for one property located at Cabot Drive (unnumbered) for the construction of Davidson Branch Equalization Facility zoned SP-MU, (Project No. 11-SC-111 and Proposal No. 2014M-012PR-001).

WHEREAS, the acquisition of property through negotiations, condemnation, or fee simple take, for one property located at Cabot Drive (unnumbered) are needed to construct the Davidson Branch Equalization Facility, zoned SP-MU, Project No. 11-SC-111; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-012PR-001 on March 20, 2014, to acquire said property through negotiations, condemnation, or by fee simple take.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to acquire property through negotiations, condemnation, or fee simple take, for one property located at Cabot Drive (unnumbered) for the construction of Davidson Branch Equalization Facility zoned SP-MU, as listed below and shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations, condemnation, or fee simple take authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2014-785

Madam President:

I move to amend Ordinance No. BL2014-785 by renumbering the existing Section 4 as Section 5, and adding the following new Section 4:
Section 4. By a Letter of Intent dated June 12, 2014 from MWS Director Scott Potter to the West Harpeth Funeral Home, a copy of which is attached hereto and incorporated herein, MWS commits to using reasonable efforts to: (1) locate the proposed wet weather storage tank and pumping station as far as practical from the West Harpeth Funeral Home; and (2) pursue an exchange of property with West Harpeth Funeral Home that would allow MWS to acquire or use a portion of property located at 6954 Charlotte Pike as an access road for utility construction and allow West Harpeth Funeral Home to acquire or use a portion of property located at 6950 Charlotte Pike.
