ORDINANCE NO. BL2014-783

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire all or a portion of the property located at 864 Idlewild Drive for the construction of the Clean Water Nashville Overflow Abatement program project (Gibson Creek Equalization Facility), (Project No. 11-SC-0139; OAP.C.33.01 and Proposal No. 2014M-007PR-001).

WHEREAS, the acquisition of all or a portion of the property located at 864 Idlewild Drive is needed to construct the Clean Water Nashville Overflow Abatement program project (Gibson Creek Equalization Facility) No. 11-SC-0139; OAP.C.33.01; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-007PR-001 on February 28, 2014, for the acquisition of said property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to acquire all or a portion of the property located at 864 Idlewild Drive for the construction of the Clean Water Nashville Overflow Abatement program project (Gibson Creek Equalization Facility), as listed below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acquisition authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
