Metropolitan Council Meeting
Tuesday, April 4, 2006


The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Reverend Henry Blaze of Progressive Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Civil Service Commission
Reappointment of Mr. Steve Corbitt for a term expiring March 31, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Access Television Special Committee
Reappointment of Ms. Meg Mazzone for a term expiring March 1, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Educational Access Corporation
Appointment of Ms. Carole McDaniel for a term expiring February 5, 2009. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board
Appointment of Mr. Jeff Kellar for a term expiring May 17, 2008. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire and Building Code Appeals Board
Appointment of Ms. Cynthia DuRant for a term expiring March 1, 2010. Ms. Durant will serve as the business/finance representative on the Board. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Greg Page for a term expiring March 1, 2010. Ms. Durant will serve as the building/construction representative on the Board. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Douglas MacKenzie for a term expiring March 1, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission
Reappointment of Ms. Ann Eaden for a term expiring August 10, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Parks and Recreation Board
Reappointment of Justice Adolpho Birch, Jr. for a term expiring March 30, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Reappointment of Mr. Victor Tyler for a term expiring March 31, 2010. Without objection the nomination was deferred to April 18, 2006.

Social Services Commission
Reappointment of Ms. Linda Mattson for a term expiring April 3, 2011. Without objection the nomination was deferred to April 18, 2006.

Reappointment of Ms. Kathy Austin for a term expiring April 3, 2011. Without objection the nomination was deferred to April 18, 2006.

RESOLUTION NO. RS2006-1212

A resolution approving an Interlocal Agreement between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of the Metropolitan Government, and the City of Berry Hill for access to 800-MHZ for emergency radio dispatching and response. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees. RESOLUTION NO. RS2006-1213

A resolution approving a secured loan from The Metropolitan Government of Nashville and Davidson County to the Hospital Authority of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Health, Hospitals and Social Services Committee; the Budget and Finance Committee approved the resolution with two amendments. Ms. McClendon moved that Amendment Nos. 1 and 2 be considered together; Mr. Wallace objected and the amendments were considered individually. Mr. Briley offered Amendment No. 1 and moved for its adoption, which motion was seconded. Mr. Isabel moved to table the motion, which motion was seconded and failed by a voice vote of the Council. Mr. Shulman offered Amendment No. 2 and moved for its adoption, which motion was seconded. After discussion Mr. Shulman requested unanimous consent to amend Amendment No. 2; Mr. Isabel objected and no amendment was made. The matter recurred on the motion to adopt Amendment No. 2, which motion was adopted by a voice vote of the Council. A resolution approving an amendment to a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County for the development of an exercise program that encompasses all aspects of homeland security (No. Z-04-019754-01). A resolution accepting a grant from the Community Foundation of Middle Tennessee to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of the District Attorney General, for personnel to review, coordinate, and prosecute cases of firearm crimes. A resolution appropriating the amount of $11,866,473 from the General Fund Reserve Fund for the purchase of equipment and building repairs for the General Services Department of The Metropolitan Government of Nashville and Davidson County. RESOLUTION NO. RS2006-1257

A resolution appropriating $90,300 for the Metropolitan Board of Health pursuant to a grant from the Tennessee Department of Health for the Women, Infants, and Children (WIC) program. An ordinance amending Chapter 4.04 of the Metropolitan Code of Laws to require the Metropolitan Purchasing Agent to submit a monthly report to the Metropolitan Council regarding all procurement contract awards. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2006-1013

An ordinance amending Chapter 4.12 of the Metropolitan Code of Laws to require that certain procurement contracts be approved by Resolution of the Metropolitan Council. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2006-1014

An ordinance amending Chapter 4.12 of the Metropolitan Code of Laws to require that procurement contracts in excess of Three Million Dollars ($3,000,000) be approved by Resolution of the Metropolitan Council. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance by a voice vote of the Council.

BILL NO. BL2006-1015

An ordinance authorizing certain departments, boards, and commissions of the Metropolitan Government to accept donations valued at less than or equal to $5,000, and providing for Council approval by Resolution for acceptance of donations valued at more than $5,000.
