SUBSTITUTE ORDINANCE NO. BL2005-926
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 and OR20 to SP district properties located at 4605 Georgia Avenue and 600, 602, 606, 608 and 610 47th Avenue North (1.24 acres), all of which is described here in (Proposal No. 2005SP-152U-07).NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By changing from R6 and OR20 to SP district properties located at 4605 Georgia Avenue and 600, 602, 606, 608 and 610 47th Avenue North (1.24 acres), as being Property Parcel Nos. 125, 126, 127, 128, 130, 131 as designated on Map 091-12 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.
Section 2. Be it
further enacted, that the Metropolitan Clerk is hereby authorized and directed,
upon the enactment and approval of this ordinance, to cause the change to be
made on Sheet No. 091 of said Official Zoning Map for Metropolitan Nashville
and Davidson County, as set out in Section 1 of this ordinance, and to make
notation thereon of reference to the date of passage and approval of this amendatory
ordinance.
Section 3. Be it further enacted, that all CS district uses be permitted, with
the exception of the following 36 uses:
" Assisted-care living
" Hospice
" Hospital
" Nonresidential drug treatment facility
" Rehabilitation services
" Residence for handicapped (8 or more)
" Bar or nightclub
" Car wash
" Home Improvements sales
" Hotel/motel
" Laundry plants
" Liquor sales
" Self-service
" Radio/TV/satellite tower
" Fuel storage
" Heavy equipment sales
" Bus station/landport
" Bus transfer station
" Park and ride lot
" Water taxi station
" Power/gas substation
" Power plant
" Reservoir/water tank
" Safety services
" Waste water treatment
" Water/sewer pump station
" Water treatment plant
" Construction/demolition landfill
" Medical Waste
" Recycling collection center
" Club
" Drive in movie
" Driving range
" Golf course
" Cemetery
Section 4. Be it further enacted, that the bulk regulations and other zoning standards for the CS district shall be applied to this property.
Section 5. Be it further enacted, that all ground signs shall be monument signs, and that the maximum building height shall be thirty-five (35) feet.
Section 6. Be it further enacted, that the uses contemplated by the property owner are retail, restaurant, mixed uses and parking.
Section 7. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
