ORDINANCE NO. BL2006-993

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in the public projects for The Metropolitan Government of Nashville and Davidson County and initially with relation to the expansion of Fire Station #16 located in the Belmont-Hillsboro area (Proposal No. 2006M-027U-10).

Whereas, the Metropolitan Government is given the power by Sections 2.01(12), (5) of the Metropolitan Charter to provide for the taking and appropriation of real property within the area of the Metropolitan Government for any public purpose, when the public convenience requires it and in accordance with the provisions of Tennessee Code Annotated, Section 29-16-101 et seq., and also the power to purchase real property for any public purpose; and,

Whereas, under Section 8.302 of the Metropolitan Charter, the Fire Department is charged with the responsibility of protecting against fire; and,

Whereas, it is in the public interest that certain property identified as Parcel 203.00, on Tax Map 104-15-0, attached hereto as Exhibit A, be acquired through negotiation or condemnation initially for the expansion of Fire Station #16 located in the Belmont/ Hillsboro area; and,

Whereas, the funds to defray the cost of this public project are available from Fund Number 48170, Business Unit Number 15494114.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire by negotiation or condemnation the property as attached hereto in Exhibit A for use in public projects of the Metropolitan Government, initially with relation to the expansion of Fire Station No. 16 in the Belmont?Hillsboro area.

Section 2. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee requiring it.
