ORDINANCE NO. BL2006-1009

An ordinance abandoning a 10" sanitary sewer line and easement, authorizing the acceptance of an easement and sewer line, and authorizing the acceptance of a fire hydrant, all of which is shown on Map 092-08, Parcels 99 and 100, and Map 098-12, Parcels 7-11, 17, 18, and 506, Projects 05-SL-86/05-WL-85, Walgreens-Charlotte Pike at Dr. D.B. Todd Jr. Boulevard., and authorizing the execution of documents necessary therefore (Proposal No. 2005M-250U-08).

WHEREAS, a 10" sanitary sewer line and accompanying easement, more particularly described in Project No. 05-SL-86/05-WL-85, Walgreens-Charlotte Pike at D.B. Todd Blvd., on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a sanitary sewer line of equal size will be replacing the existing 10"sanitary sewer line; and

WHEREAS, a grant of an easement has been executed by the property owner and offered to the Metropolitan Government of Nashville and Davidson County, inclusive of a sewer line located on the same property; and

WHEREAS, the easement and sewer line thereon are described in Exhibit 1 hereto and are further described in the Metropolitan Water and Sewerage Services Department's plans on file for Project No. 05-SL-86/05-WL-85, Walgreens-Charlotte Pike at D.B. Todd Blvd., and are for the purposes of that Project; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-250U-08 on December 15, 2005.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan Government hereby abandons the 10" sanitary sewer line and the easement shown on Map 092-08, Parcels 99 and 100, and Map 098-12, Parcels 7-11, 17, 18, and 506, Projects 05-SL-86/05-WL-85, Walgreens-Charlotte Pike at D.B. Todd Boulevard, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept from the respective property owner the easement, sewer line, and fire hydrant described in the Metropolitan Water and Sewerage Services Department's plans on file for Project No. 05-SL-86/05-WL-85, Walgreens-Charlotte Pike at D.B. Todd Blvd., for the purposes of that project, and located on the property described in Exhibit 1 hereto, which plans and Exhibit are incorporated herein.

SECTION 3. The easement shall be filed in the Office of the Register of Deeds to evidence its acceptance.

SECTION 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
