ORDINANCE NO. BL2006-1007

An ordinance abandoning a 15" sanitary sewer line and easement that will be replaced by a 15" sanitary sewer line and easement, that is shown on Map 161, Parcels 101-103, 105, 107, 112, and 189 and Map 162, Parcels 78-82, Project 05-SL-118, Wal-Mart, Nolensville Road, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2005M-211U-12).

WHEREAS, a 15" existing sanitary sewer line and accompanying easement, more particularly described in Project No. 05-SL-118, Wal-Mart, Nolensville Road, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a 15" sanitary sewer line and easement of equal size will be replacing the existing 15" sanitary sewer line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-211U-12 on November 15, 2005 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 15" sanitary sewer line and the easement shown on Map 161, Parcels 101-103, 105, 107, 112, and 189, and Map 162, Parcels 78-82, Project No. 05-SL-118, Wal-Mart, Nolensville Road as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
