An ordinance approving and authorizing the Metropolitan Mayor to enter into Supplemental Agreement No. NWR UEW-2005-1, with Nashville and Western Railroad Corporation, to grant a 50' length of water main right-of-way, located at the intersection of Charlotte Avenue and 31st Avenue.

WHEREAS, Nashville and Western Railroad Corporation owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to acquire a railroad right-of-way located at Charlotte Avenue and 31st Avenue, Nashville, Tennessee for the purpose of a water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That Supplemental Agreement No. NWR UEW-2005-1, attached hereto and incorporated herein, is approved, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That amendment to the Agreement and future agreements with Nashville Western Railroad concerning the use of railroad right-of-way for stormwater drainage and water and sewer line construction may be approved by resolution.

SECTION 3: That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
