ORDINANCE NO. BL2005-907
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of an Institutional Overlay District to various properties located between Gallatin Pike and Emmett Avenue, and between McClurkan Avenue and Douglas Avenue, (35.73 acres), all of which is described here in (Proposal No. 2005P-029U-05).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By making applicable the provisions of an Institutional Overlay District to various properties located between Gallatin Pike and Emmett Avenue, and between McClurkan Avenue and Douglas Avenue, (35.73 acres), as being various Property Parcel Nos. as designated on Map 072-13 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.
Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 072 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.
Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:
I move to amend Ordinance No. BL2005-907 as follows:
1. By deleting Section 3 in its entirety and substituting in lieu thereof the following new Section 3:
"Section 3. Be it further enacted, that the following conditions shall apply to the master development plan for the Nashville Auto Diesel College Institutional Overlay district as identified in Section 1 of this Ordinance:
1. Nashville Auto Diesel College ("NADC") shall hold quarterly neighborhood meetings for the purpose of providing area residents and businesses with a) up-to-date information on the implementation of its master plan, and b) a forum for discussing any operational issues. NADC shall provide the space and mail notices of the time and place. The mailing list shall include all addresses and owners within at least a two-block area on all sides of the campus. The first meeting shall occur within 90 days from final approval of this Institutional Overlay. Subsequent meetings shall occur every 90 days or sooner for the duration of the Institutional Overlay or until NADC and its district Council representative mutually agree to cease meeting.
2. NADC shall provide
video camera surveillance of one or more segments of its campus with the initial
segment to include the Douglas Dormitory site. The College may provide the video
camera surveillance through one of the following:
a) professional security company ownership and operation through contract agreement;
b) NADC ownership and operation; and, c) a combination of professional security
company and NADC ownership and operation. NADC shall install the initial segment
of the video camera surveillance within 90 days from final approval of the Institutional
Overlay. Based on testing and evaluation criteria supporting the expansion,
additional segments may be provided by NADC within 365 days from final approval
of the Institutional Overlay. NADC shall maintain the video camera surveillance
on a continual basis for the duration of the Institutional Overlay or until
NADC and its district Council representative mutually agree to cease surveillance.
3. NADC understands that if it is not in compliance with items 1 and 2 above at the time of any application for major site plan approval said approval may be withheld by the Metropolitan Planning Commission until NADC is in compliance.
2. By adding the following new Section 4:
"Section 4. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it."
