SUBSTITUTE ORDINANCE NO. BL2006-1044

An Ordinance amending Chapters 17.04 and 17.08 of Title 17 of the Metropolitan Code, Zoning Regulations, to add the use "After hours establishment" as a use permitted in the CC and CF districts, all of which is more specifically described herein (Proposal No. 2006Z-064T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.04.060 by adding the following new definition of "After hours establishment":

"After hours establishment" means a commercial establishment, which is not intended for long-term or short-term residential use by its patrons, which is open to the general public (with or without an admission fee), and knowingly allows its patrons to bring beer or alcoholic beverages onto the premises (BYOB or brown-bagging) between the hours of three o'clock (3:00) a.m. and six o'clock (6:00) a.m.

Section 2. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.08.030, District Land Use Tables, by adding under "Commercial uses" the use "After hours establishment" as "P" (permitted) in the CC and CF districts.

Section 3. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
