Metropolitan Council Meeting
Tuesday, December 7, 1999


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Arrold Martin of First Baptist Church, Capitol Hill.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Action Commission

Appointment of Dr. Calvin Atchison to the Metropolitan  Action Commission. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Alarm Appeals Board

Reappointment of Mr. Rufus Marable to the Alarm Appeals Board. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Auditorium Commission

Appointment of Ms. Pam Garrett to the Auditorium Commission. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Beer Permit Board

Appointment of Mr. Al Cocke and the reappointments of Messrs. Gary Brown, Charles Campbell, Dave Coleman and Sam Whitmon and Ms. Joy Sims to the Beer Permit Board. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointments, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Charitable Solicitations Board

The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointments, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Corrections Advisory Board

Appointment of Ms. Kaki Friskics-Warren to the Community Corrections Advisory Board. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Convention Center Commission

Appointment of Ms. Marilyn Robinson to the Convention Center Commission. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Board

Appointment of Mr. James Shaw to the Electrical Examiners and Appeals Board. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Development and Housing Agency

Appointment of Mr. Robert Smith to the Metropolitan Development and Housing Agency. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Social Services Commission

Appointment of Ms. Gwen Harris to the Social Services Commission. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment. Mr. Waters moved for confirmation, which motion was seconded. Mr. Shulman moved to defer the confirmation, which motion was seconded and failed by a roll call vote of the Council. After discussion, Mr. Briley called for the previous question, which motion was seconded and adopted by a voice vote of the Council. Traffic and Parking Commission

Appointment of Ms. Barbara Toms to the Traffic and Parking Commission. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Wastewater Hearing Authority

Appointment of Mr. Albert Malone to the Wastewater Hearing Authority. The Rules-Confirmations-Public Elections-Aviation Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

The President announced that an election would be held at this time to fill vacancies on the Industrial Development Board of the Metropolitan Government. Nominations previously made were: Mrs. Nettie Scalf, Messrs. David A. Dice, and Michael Hampton. Mr. Waters, Chairman of the Rules-Confirmations-Public Elections-Aviation Committee, reported that the Committee had interviewed the candidates and found each to be qualified for the position. At this time Resolution No. RS99-75 was called up for consideration.

RESOLUTION NO. RS99-75

A resolution electing four members to the board of directors of the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. Mr. Alexander offered a substitute resolution and moved that it be accepted for filing and no objection was made.

SUBSTITUTE RESOLUTION NO. RS99-75

A substitute resolution electing three members to the board of directors of the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections-Aviation Committee. Mr. Alexander moved to adopt the resolution, which motion was seconded and adopted by the following vote: "Ayes" Ferrell, Waters, Briley, Gentry, Tucker, Gilmore, Black, Nollner, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, McClendon, Greer, Wallace, Haddox, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, Jenkins, Turner, Williams, and Lineweaver (39); "Noes" (0).

The President called for nominations to fill two (2) Council member seats on the Council Audit Committee. Mr. Black nominated Mr. Gentry; Mr. Turner nominated Mr. Jenkins. There being no further nominations, the President declared the nominations closed. Mr. Ponder moved to elect by acclamation Mr. Gentry and Mr. Jenkins to serve on the Council Audit Committee for terms expiring August 31, 2000, which motion was seconded and adopted by a unanimous vote of the Council.

The President announced the vacancy in the offices of Public Administrator, Public Guardian and Public Trustee. Nominations must be filed with the Metropolitan Clerk not later than 4:00 p.m. on Tuesday, December 14, 1999, and the election for the positions will occur at the first regular meeting in January 2000 pursuant to the Rules of Procedure of the Metropolitan Council.

- RESOLUTIONS-

RESOLUTION NO. RS99-69

A resolution approving the property at 410 Chestnut Street to be used for a waste transfer facility. The Public Works and Planning, Zoning, Historical and Port Authority Committees recommended deferment of the resolution. Mr. Wallace moved defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS99-70

A resolution authorizing the Director of Public Property to exercise an option to purchase a permanent easement (located on Parcel 47 on Tax Map 156) in which to install and maintain a water line to serve the new Warner Park Nature Center Complex. The resolution was approved by the Planning Commission, Budget and Finance, Public Works, Parks, Library, Recreation and Auditorium and Planning, Zoning, Historical and Port Authority Committees. A resolution electing Dr. Gadson Jack Tarleton, Jr., to the Board of Directors of the Health and Educational Facilities Board of the Metropolitan Government of Nashville and Davidson County, Tennessee. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Ms. Gilmore moved to defer action on the resolution until the nominee can meet with the Committee prior to his confirmation, which motion was seconded and adopted by a voice vote of the Council.

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of James K. McKenzie against certain Metropolitan police officers for an amount not to exceed $30,000.00 and directing that this amount be paid from the judgment and losses liability account.
