ORDINANCE NO. BL99-119

An ordinance to grant a permanent easement from The Metropolitan Government of Nashville and Davidson County for the construction and maintenance of a 50 foot road for purposes of ingress and egress over and across certain property owned by the Metropolitan Government (Tax Map 143, Parcel 24), (99M-143G-06), requested by William E. Kantz Jr., Appellant.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Tennessee, owns certain property used by the Metropolitan Board of Parks and Recreation as part of the Warner Park (Tax Map 143, Parcel 24) as depicted on attached Exhibit A; and

WHEREAS, William E. Kantz, Jr. desires a permanent easement (as depicted on the attached Exhibit B) over and across certain property for the construction and maintenance of a 50 foot road for purposes of ingress to and egress from the real property described as property as Tax Map 143, Parcel 20; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The granting of a permanent 50 foot easement (as depicted on the attached Exhibit B) on Tax Map 143, Parcel 24, to William E. Kantz, Jr. is hereby approved.

SECTION 2. This Ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
