RESOLUTION NO. RS99-76

A resolution authorizing the Director of Public Property to exercise two options to purchase real property (Map 60-1, Parcels 174 and 177) as part of Public Works Project No. 84W028B.

WHEREAS, Resolution No. R96-295 approved several public improvement projects, as part of the Mayor’s 1995-1996 Infrastructure Program, including Project No. 84W028B, Ewing Creek, flood mitigation; and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council."; and

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated to purchase certain property (Map 60-1, Parcels 174 and 177) located in Davidson County as shown on Exhibit A and incorporated into this resolution by reference; and

WHEREAS, said purchase has been considered and approved by the Metropolitan Planning Commission (Proposal No. 99M-122U); and

WHEREAS, it is deemed in the best interest of the Metropolitan Government to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration is hereby authorized to exercise the options to purchase the property (Map 60-1, Parcels 174 and 177) as shown on Exhibit A and to execute the necessary documents pertaining thereto.

SECTION 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
