RESOLUTION NO. RS99-80

A resolution ratifying Amendment No. 2 to the contract between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County for improvement to SR-254, Old Hickory Boulevard intersection with Granny White Pike, Project No. CM-STP-254(4).

Whereas, the Transportation Improvement Program (TIP) programs a congested intersection project for the Metropolitan Nashville area with Congestion Mitigation Air Quality Funds and Federal-Aid Urban System funds; and

Whereas, The Department of Transportation of the State of Tennessee, hereinafter called "State" has tentatively allocated certain funds for the intersection improvements in the area of The Metropolitan Government of Nashville and Davidson County, Tennessee, hereinafter called "Metro" known and described as follows:

Whereas, Ordinance No. O95-122 authorized a contract between the State and Metro for the implementation of a project for the intersection improvements at SR-254, Old Hickory Boulevard and Granny White Pike; and

Whereas, Ordinance No. O95-122, authorized the Metropolitan County Mayor to execute any and all contracts for said project; and

Whereas, a contract with the State was executed pursuant to Ordinance No. O95-122; and

Whereas, Ordinance No. O95-122 states that any and all additional contracts between the State and Metro for SR-254, Old Hickory Boulevard intersection with Granny White Pike must be ratified by Resolution by the Metropolitan County Council; and

Whereas, Amendment No. 1 to the contract was authorized by Resolution No. R96-510, and executed pursuant thereto; and

Whereas, the Metropolitan Government and the State desire to further amend the contract for the purpose of allocation of additional Congestion Mitigation Air Quality funds to the construction phase of the project, and for other purposes;

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The amendment to the contract submitted by the State of Tennessee, Department of Transportation to The Metropolitan Government of Nashville and Davidson County for the development of the intersection improvements at SR-254, Old Hickory Boulevard and Granny White Pike is hereby ratified by the adoption of this resolution, and the Metropolitan County Mayor is authorized to execute said amendment.

Section 2. Amendment No. 2 to Contract No. 655 is hereby incorporated and made a part of this Resolution, the same as though copied herein.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
