RESOLUTION NO. RS99-77

A resolution authorizing and directing the Director of Public Property to exercise an option to purchase improved property (Tax Map 71-3, Parcel 1 – 2644 Locust Street) for The Metropolitan Government of Nashville and Davidson County and specifically for the benefit of and use by the 20th Judicial District Drug Task Force.

WHEREAS, the 20th Judicial District Drug Task Force is currently located at 1106 Woodland Street; and

WHEREAS, the lease on this Woodland Street property has expired and the property owner, M.D.H.A., wants to utilize the property for other neighborhood development and has ask the Drug Task Force to relocate; and

WHEREAS, the 20th Judicial District Drug Task Force, working in conjunction with the Director of Public Property, has found improved property that will satisfy its demands and needs; and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council."; and

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option to purchase certain property located in Davidson County as shown on Exhibit A and incorporated into this resolution by reference; and

WHEREAS, funds to purchase said property are available from drug fines and forfeitures awarded to the 20th Judicial District Drug Task Force; and

WHEREAS, it is deemed in the best interest of the Metropolitan Government and the 20th Judicial District Drug Task Force to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration is hereby authorized and directed to exercise the option to purchase the improved property (Tax Map 71-3, Parcel 1 – 2644 Locust Street) as shown on Exhibit A and to execute the necessary documents pertaining thereto.

SECTION 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
