Metropolitan Council Meeting
Tuesday, June 4, 2013


The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Pastor John McCullough of Woodland Presbyterian Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Steine, Garrett, Tygard, Maynard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Pardue, Glover, Stanley, Claiborne, Tenpenny, Moore, Allen, Langster, Weiner, Evans, Holleman, McGuire, Harmon, Blalock, Dominy, Johnson, Potts, Dowell, Duvall, Todd and Mitchell (35); Absent: Jernigan, Stites, Gilmore, Baker, Bedne, Neighbors (6).

The Minutes of the regular meeting of May 21, 2013, were approved.

President Pro Tempore Todd presided in the absence of Ms. Neighbors.

Councilman Anthony Davis moved that at the time of adjournment the Council adjourn to Tuesday, June 11, 2013, at 6:00 pm for the purpose of considering Ordinance No. BL2013-467, the Capital Improvements Budget for fiscal year 2014, on third and final reading along with the Mayor’s capital spending plan Resolution RS2013-710 and with any other matters that the Vice Mayor deems appropriate for consideration at that time, which motion was seconded and adopted without objection.

Community Education Commission
President Pro Tempore Todd announced that nominations are being accepted to fill a vacancy on the Community Education Commission for a nonprofit adult literacy organization representative, which seat is to be filled by the Council. Nominations must be filed with the Metropolitan Clerk not later than 4:00 pm on Tuesday, June 11, 2013. Nominees will be referred to the Rules-Confirmations-Public Elections Committee for a recommendation, and the appointment will be made at the next regular meeting of the Council.

- PROPOSED RULES AMENDMENT -

The Rules-Confirmations-Public Elections Committee recommended approval of the following proposed amendment to the Rules of Procedure of the Metropolitan Council.

Rule 32 of the 2007-2011 Council Rules of Procedure is amended by deleting the first paragraph in its entirety and substituting with the following new paragraph:

“Members of the public may address the Council in a public hearing format regarding a specific resolution or ordinance when a public hearing is not otherwise required by law if the Council approves a motion by a two-thirds vote of the Council members present at such meeting to allow members of the public to address the Council at the next regular meeting regarding such ordinance or resolution. As a part of the authorizing motion, the Council shall set the time period for the public hearing and a time limit for individual speakers, as well as such other terms of the public hearing as it shall deem prudent.”

Electric Power Board
Appointment of Ms. Irma Paz Bernstein for a term expiring July 1, 2017. Ms. Bernstein will fill the unexpired term of Mr. Richard Courtney. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Reappointment of Mr. Mark Baugh for a term expiring April 18, 2016. At the request on the nominee, the confirmation was deferred.

Reappointment of Mr. King Hollands for a term expiring April 18, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Sharon Kay for a term expiring April 18, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Alistair Newbern for a term expiring April 18, 2016. At the request on the nominee, the confirmation was deferred.

Reappointment of Mr. Don Peterson for a term expiring April 18, 2016. At the request on the nominee, the confirmation was deferred.

Sexually Oriented Business Licensing Board
Appointment of Mr. Jonathan Richardson for a term expiring October 10, 2015. Mr. Richardson will fill the unexpired term of Mr. Alan Johnson. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Traffic and Parking Commission
Reappointment of Rev. Breonus Mitchell for a term expiring April 3, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Mary Vavar for a term expiring April 3, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transit Authority
Reappointment of Mr. Thomas F. O’Connell for a term expiring May 18, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

SUBSTITUTE BILL NO. BL2013-448

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to OR20 zoning for property located at 602 33rd Avenue North, at the northeast corner of Trevor Street and 33rd Avenue North (0.49 acres), all of which is described herein (Proposal No. 2013Z-015PR-001). The bill was approved by the Planning Commission. Ms. Langster requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Langster moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-449

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for properties located at 904 Chicamauga Avenue and 941 W. Eastland Avenue, approximately 125 feet east of McFerrin Avenue (0.34 acres), to permit a mixture of uses including restaurant (full service), retail, office and personal care services uses in addition to single and two family residential, all of which is described herein (Proposal No. 2013SP-014-001). The bill was approved by the Planning Commission with conditions, disapproved without.

The President asked if anyone desired to be heard for or against the bill and a citizen was heard in opposition to passage of the bill. The President declared the public hearing closed. BILL NO. BL2013-450

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the preliminary plan for a portion of the Woodbury Planned Unit Development Overlay District located at Woodbury Falls Drive (unnumbered), approximately 460 feet west of Old Hickory Boulevard, zoned R15 (7.96 acres), to permit 19 single-family lots where 11 single-family lots were previously approved, all of which is described herein (Proposal No. 97P-027-001). The bill was approved by the Planning Commission with conditions. Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. Ms. Weiner moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-453

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS and RS7.5 to SP zoning for properties located 332 and 322 54th Avenue North and 323 53rd Avenue North, approximately 400 feet south of Charlotte Avenue (3.12 acres), to permit up to 40 residential units, all of which is described herein (Proposal No. 2013SP-016-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Holleman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Holleman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-467

An ordinance adopting the Capital Improvements Budget and Program 2013-2014 through 2018-2019 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2013-2014. The bill was approved by the Planning Commission and Budget and Finance Committee. Mr. Matthews requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. The bill was approved by the Budget and Finance Committee. Mr. Matthews moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2013-709

A Twenty-Fifth Supplemental Electric System Revenue Bond Resolution supplementing certain resolutions of The Metropolitan Government of Nashville and Davidson County by authorizing the issuance of Electric System Revenue Refunding Bonds, 2013 Series A, as requested by the Electric Power Board of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-714

A resolution approving a contract with Pictometry International Corp. for the provision of digital aerial photography of Davidson County and related software. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-715

A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police and Fire Departments, and the State of Tennessee, by and through the Tennessee Departments of Transportation and Homeland Security, to expedite the removal of vehicles, cargo, and debris from Tennessee highways following a motor vehicle crash or incident. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee.

RESOLUTION NO. RS2013-716

A resolution approving an application for the Governor’s Highway Safety Alcohol Saturation Grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to reduce traffic crashes and fatalities by enhancing DUI enforcement patrols primarily on weekends and some holidays. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2013-717

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide food safety services to Davidson County residents and to conduct surveys as required. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-718

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide bioterrorism emergency preparedness services to the citizens of Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-719

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide health promotion services to Davidson County residents. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-720

A resolution approving amendment one to a grant from the U. S. Department of Health and Human Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to create a comprehensive strategy to address issues and barriers to responsible fatherhood. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-721

A resolution approving a contract for services by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Corrections Corporation of America to provide services to male offenders, who are fathers, through the New Life Program. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2013-722

A resolution approving an agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, for the Cumberland River and Tributaries in Davidson County Feasibility Study being conducted in Davidson County, Tennessee, and authorizing all necessary officials to execute the same. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2013-723

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s personal injury claim against Leon Flenoy. The resolution was approved by the Budget and Finance Committee.

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Three Hundred Million Dollars. The Budget and Finance Committee recommended deferment. Mr. Matthews moved to defer the resolution to track with the Capital Improvements Budget, which motion was seconded and adopted by a voice vote of the Council.
