RESOLUTION NO. RS2013-723

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s personal injury claim against Leon Flenoy.

WHEREAS, on November 11, 2011, a Metropolitan Nashville General Services Department vehicle operated by Jacqueline Claywell was traveling west on interstate 24 when the vehicle in which she was riding was struck in the rear by a vehicle operated by Leon Flenoy, resulting in personal injury to Ms. Claywell; and,

WHEREAS, the Metropolitan Government incurred costs related to the medical treatment of Jacqueline Claywell; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $13,206.50.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its claim against Leon Flenoy in an amount totaling $13,206.50, which shall be deposited into an appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
