Metropolitan Council Meeting
Tuesday, February 5, 2002


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Brenda Gilmore.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

PROPOSED AMENDMENT TO COUNCIL RULE 23

Amendment to Rule 23 of the Council Rules of Procedure would require that any resolution or any ordinance filed on first reading which is not introduced or co-sponsored by the Council member in the district concerned with the subject matter must be deferred two meetings. This amendment does not apply to zoning matters, which are already governed by Rule 9. The proposed rule change was approved by the Rules-Confirmations-Public Elections-Aviation Committee as amended. Ms. Gilmore moved to defer action on the proposed rule change for two meetings, which motion was seconded and adopted by a voice vote of the Council.

Appointment of Ms. Eleanor Davis to the Alarm Appeals Board for a term expiring November 4, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Nashville Arts Commission
Reappointment of Dr. Paulette Coleman to the Metropolitan Nashville Arts Commission for a term expiring January 1, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Gas/Mechanical Examiners and Appeals Board
Reappointment of Mr. Kenny Watson to the Gas/Mechanical Examiners and Appeals Board for a term expiring January 20, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Tourism and Convention Commission
Appointment of Mr. Jay D. Sevigny to the Metropolitan Tourism and Convention Commission for a term expiring June 30, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2001-845

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and adopt legislation to provide for a sales tax on advertisements, including television, print, and outdoor advertisement. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Wallace moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-878

A resolution supplementing and amending Resolutions No. RS2001-510 and RS2001-786 of the Metropolitan County Council and awarding the sale of General Obligation Multi-Purpose Refunding Bonds, Series 2002A. The Budget and Finance Committee recommended indefinite deferment of the resolution. Mr. Shulman moved to defer action indefinitely on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-926

A resolution approving the property at 4300 Georgia Avenue to be used for a waste transfer station. The Public Works and Planning, Zoning, and Historical Committees recommended deferment of the resolution. Mr. Whitmore moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-932

A resolution proclaiming the week of February 4, 2002, through February 8, 2002, as National School Counseling Week. The resolution was approved by the Education Committee. A resolution requesting the Mayor and the Metropolitan Civil Service Commission to declare Patriot Day, September 11th, as a Metropolitan Government holiday. Mr. Lineweaver offered a substitute resolution and moved that it be accepted for filing and no objection was made.

SUBSTITUTE RESOLUTION NO. RS2002-933

A substitute resolution declaring September 11th Patriot Day and requesting the Mayor to plan an appropriate annual memorial recognition. The substitute resolution was approved by the Rules-Confirmations-Public Elections Committee. A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to support the adoption of legislation SB1235/HB0295 that would enable local governments to impose real estate transfer taxes. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Bogen moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-935

A resolution requesting the Metropolitan Traffic and Parking Commission to reconsider its decision to deny 30 minutes of free parking in all Metro-owned lots and garages if persons park only 30 minutes or less. The Traffic and Parking Committee recommended deferment of the resolution. Mr. Wallace moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-936

A resolution requesting the Metropolitan Traffic and Parking Commission to examine the feasibility of permitting parking within the Central Business Improvement District between the hours of 6:00 p.m. and 6:00 a.m. in some spaces where parking is now prohibited. The Traffic and Parking recommended deferment of the resolution. Mr. Wallace requested a suspension of the rules to override the committee recommendation for deferment, which motion was seconded and adopted without objection. A resolution requesting the Metropolitan Board of Parks and Recreation to reopen the downtown ice skating rink at Riverfront Park. RESOLUTION NO. RS2002-939

A resolution requesting the Metropolitan Department of Public Works to initiate a policy to reinstall residents' mailboxes knocked down as a result of traffic accidents, vandalism, or other unforeseen circumstances, which were originally installed into the sidewalk by the Department of Public Works. The Public Works Committee recommended deferment of the resolution. Mr. Dillard moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.
