A resolution approving the waiver of certain benefit overpayments to members and beneficiaries of the Metropolitan Employee Benefit System caused by errors made by the staff of the Employee Benefit Board.

Whereas, certain members and beneficiaries of the Metropolitan Employee Benefit System have received an overpayment of benefits due to errors made by the staff of the Employee Benefit Board; and

Whereas, Section 3.08.230(C) of the Metropolitan Code of Laws permits the Employee Benefit Board to waive such overpayments after making certain specified determinations; and

Whereas, the Employee Benefit Board has made the determinations necessary to waive such overpayments; and

Whereas, the Employee Benefit Board has approved the waiver of such overpayments; and

Whereas, the waiver of overpayments must be approved by the Metropolitan Council by resolution before it is final and takes effect;

Now, therefore be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The waiver of overpayments approved by the Employee Benefit Board as shown on the attached Exhibit 1 is hereby approved.

Section 2. This resolution shall take effect from and its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
