ORDINANCE NO. BL2002-944

An ordinance authorizing Centex Homes, hereinafter known as "CENTEX", to participate with the Metropolitan Government, Department of Water and Sewerage Services, hereinafter known as "METRO", for the construction of Willowmet Phase 2 Subdivision, Project No. 99-SL-206A and Owl Creek Trunk Sewer, Project No. 97-SG-84.

WHEREAS, METRO is authorized to provide sewerage services in the area of Williamson County where this development is to be constructed; and

WHEREAS, CENTEX has expressed a desire to provide improved public sewer service in northeast Williamson County, TN, hereinafter known as Willowmet Phase 2 Subdivision, Project No. 99-SL-206A; and

WHEREAS, METRO has funded and built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000 per connection toward the cost of the Owl Creek Project; and
WHEREAS, it is deemed to benefit both parties and the general community, and CENTEX agrees to pay an amount not to exceed $56,000; and

WHEREAS, this work is identified in METRO's Capital Improvements Budget as CIB No. 96SG0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That METRO is hereby authorized to accept from CENTEX $56,000 for twenty-eight connections @ $2,000 each toward the funding of the Owl Creek Trunk Sewer, known as Project No. 97?SG?84.

SECTION 2: That future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
